　　《南宁市烟花爆竹管理规定》已经2019年1月22日市十四届人民政府第62次常务会议通过。现予公布，自2019年2月1日起施行。

　　南宁市烟花爆竹管理规定

　　第一条为了加强烟花爆竹管理，保障公共安全、人身和财产安全，改善大气环境质量，根据《中华人民共和国大气污染防治法》、《烟花爆竹安全管理条例》等有关法律法规，结合本市实际，制定本规定。

　　第二条本规定适用于本市行政区域内烟花爆竹的经营和燃放。

　　第三条市、县(区)人民政府应当建立烟花爆竹管理综合协调机制，协调解决烟花爆竹管理中的重大问题。

　　第四条安全生产监督管理部门负责烟花爆竹的监督管理，并具体协调烟花爆竹的管理工作。

　　公安机关负责烟花爆竹的公共安全管理。

　　环境保护主管部门负责烟花爆竹环境空气质量的监督管理。

　　城市管理、规划、住房、质量技术监督、工商、教育、交通、气象等部门应当按照各自职责，做好烟花爆竹安全管理工作。供销合作社应当加强对本系统企业烟花爆竹经营活动的管理。

　　第五条市、县(区)人民政府及其有关部门、乡(镇)人民政府、街道办事处、村(居)民委员会应当依法开展烟花爆竹安全燃放宣传教育活动。广播、电视、报纸、互联网等媒体应当做好烟花爆竹安全燃放的宣传工作。中小学应当教育学生文明安全燃放烟花爆竹。

　　第六条全南高速公路、南安高速公路、永武路、安武大道、高辛大道、罗文大道、明希大桥、江南大道、沙井大道、那日路、那鸿大道、友谊路、郭凯大道、海印大道、豫东大道、南安高速公路、永江南岸、彩虹路、新兴街、银丰路、翰林街、和平二街、和平三街、仙鹤路、永江南岸、仁福桥(规划)、临县路(含

　　在禁止燃放烟花爆竹的区域外，限制全南高速公路、南安高速公路、南宁绕城高速公路、南宁绕城高速公路、南安高速公路、良村大道、南苑路、翰林街、和平二街、和平三街、仙河路、永江南岸、仁福桥(规划)、临县路形成的环形道路范围内，以及禁止燃放烟花爆竹区域内的公墓。

　　市人民政府可以根据国家和自治区的有关规定，结合本市实际情况进行调整并向社会公布。

　　各县、武鸣区应当划定禁止燃放烟花爆竹的区域，并向社会公布。

　　第七条禁止燃放烟花爆竹的区域不得燃放烟花爆竹。

　　限制在烟花爆竹零售点临时销售区域内燃放烟花爆竹。

　　烟花爆竹零售点总体布局规划由县(区)安全生产监督管理部门会同公安机关和城管部门按照统一规划、确保安全、严格控制、合理布局的原则编制，经县(区)人民政府批准后实施。

　　第八条从事烟花爆竹零售的经营者应当符合法定条件，按照规定取得烟花爆竹零售许可证 law, and go through the formalities for industrial and commercial registration; Need to occupy the city road, should also obtain temporary occupation of the city road permit to operate.

　　Temporary sales outlets of fireworks and firecrackers in areas where fireworks and firecrackers are set off shall be restricted, and operators shall be determined through fair competition.The retail license period for temporary fireworks and firecrackers outlets shall not exceed 30 days.

　　Article 9 Retail operators of fireworks and firecrackers shall purchase fireworks and firecrackers from the enterprises that have obtained the wholesale license for fireworks and firecrackers according to law. After the expiration of the retail license period, they shall stop selling fireworks and firecrackers. The fireworks and firecrackers that have not yet been sold shall be bought back or kept by the wholesale enterprises, and shall not be stored by themselves.

　　Article 10 Fireworks and firecrackers are prohibited in the following places and areas:

　　(a) cultural relics protection units, museums and archives;

　　(two) stations, docks, airports and other transportation hubs and railway, rail traffic line safety protection areas;

　　(3) Refueling (gas) stations, liquefied gas supply stations (points), oil depots, parking lots, important material warehouses and other fire-free areas or other places where inflammable and explosive dangerous goods are produced, operated and stored and within 100 meters of their surroundings;

　　(four) water conservancy facilities, water, electricity and gas supply facilities in the safety protection zone;

　　(five) the party and government offices, medical institutions, kindergartens, school teaching areas, nursing homes, welfare homes, radio stations, television stations, newspapers and other units;

　　(six) scenic spots, forest land, green space, nursery, park;

　　(7) Military facilities protection zones;

　　(八)城市广场、集贸市场、步行街等拥挤的公共场所；

　　(九)建筑物、构筑物和公共走廊、楼梯、电梯、屋顶、阳台、窗户；

　　(十)城市主次干道、桥梁(包括立交桥、立交桥)、隧道、地下管线、地下人行道、防空洞、竖井；

　　(十一)法律、法规、规章和市、县(区)人民政府规定禁止燃放烟花爆竹的其他场所或区域。

　　前款规定的场所和区域的业主或者管理人应当设置明显的禁止燃放烟花爆竹的警示标志，并负责监督。

　　第十一条禁止在禁止燃放烟花爆竹的区域内任何时候燃放烟花爆竹。

　　在限制燃放烟花爆竹的区域，允许在下列时间燃放烟花爆竹，但不得在其他时间燃放:

　　(a)农历除夕，即第一个月的第一天；

　　(二)农历一月二日至六日及正月十五日上午七时至下午十二时；

　　(3)壮族“三月三日”和“清明节”期间。

　　市、县、武鸣区人民政府可以根据国家有关规定和本辖区实际情况，调整本条第二款规定的时间，并向社会发布公告。重大节日和庆典活动期间，禁止燃放或者限制燃放烟花爆竹的区域，需要燃放烟花爆竹的，由市、县、武鸣区人民政府决定并向社会公告。

　　第十二条在烟花爆竹限制区内，只准销售和燃放符合国家标准的个人烟花爆竹。

　　经公安机关批准，烟花爆竹晚会等大型烟花爆竹燃放活动不受前款规定的限制。

　　第十三条空气污染橙色和红色警戒期内，禁止在任何区域和场所燃放烟花爆竹。

　　第十四条非禁止燃放烟花爆竹区域内的村(居)民委员会和居民区业主委员会，可以依照本规定，通过村(居)民大会，商定村庄、社区或者居民区内允许燃放烟花爆竹的区域和地点。

　　对于不禁止燃放烟花爆竹的住宅区，物业服务企业可以根据业主公约，或者征求业主或者业主委员会的意见，确定住宅区内禁止燃放烟花爆竹的区域和地点，或者在住宅区内指定集中燃放点。

　　第十五条燃放烟花爆竹的单位和个人，应当严格按照产品说明书正确、安全地燃放，并遵守下列规定:

　　(一)不得在拥挤场所燃放烟花爆竹；

　　(二)不得向行人、车辆、建筑物、构筑物、动植物投射、投掷燃放烟花爆竹；

　　(三)不得妨碍行人和车辆安全通行，影响交通秩序；

　　(四)不得使用其他方式危害公共安全和人身、财产安全的烟花爆竹；

　　14岁以下未成年人燃放烟花爆竹的，应当有成年人陪同。

　　第十六条除法律允许生产、经营、运输烟花爆竹的单位和燃放大型烟花爆竹的单位外，其他任何单位和个人不得携带、运输三十公斤以上的烟花爆竹或者存放五十公斤以上的烟花爆竹。

　　第十七条有下列行为之一的，由公安机关责令改正并处以罚款，构成违反治安管理的，依法给予治安管理处罚:

　　(一)违反本条例第六条、第十条、第十一条和第十三条规定，在禁止燃放烟花爆竹的场所、区域和时间燃放烟花爆竹的，处以100元以上500元以下罚款；

　　(二)违反本条例第十二条规定，限制燃放烟花爆竹区域内的烟花爆竹种类不符合要求的，处以100元至500元罚款；

　　Article 19 Whoever, in violation of the provisions of Article 16 of these Provisions, carries or transports fireworks and firecrackers with a total weight of more than 30 kilograms or stores fireworks and firecrackers with a total weight of more than 50 kilograms shall be ordered by the public security organ to make corrections and fined between 200 yuan and 2000 yuan.

　　Twentieth other acts in violation of these provisions, laws and regulations have legal liability provisions, from its provisions.

　　Article 21 If any of the following acts is committed by the public security, production safety supervision and management administrative departments and their staff in the management of fireworks and firecrackers, the relevant departments shall punish the directly responsible person in charge and other directly responsible personnel according to law. If a crime is constituted, criminal responsibility shall be investigated according to law:

　　(a) does not fulfill the fireworks management responsibilities;

　　(two) the illegal implementation of administrative punishment;

　　(three) dereliction of duty, bending the law, abuse of power, bribery;

　　(4) Other illegal acts.

　　Article 22 These Provisions shall come into force as of February 1, 2019.On March 18, 2014, the "Regulations of Nanning Municipality on the Administration of Fireworks and Firecrackers" promulgated by the Municipal People's Government (Decree No.21南宁市人民政府令)同时废止。
